Regulation 194 - Producer Compensation Transparency - TAKES EFFECT ON 1/1/11

As you are aware, the NYS Insurance Department has promulgated its Final Regulation 194 - Producer Compensation Transparency (11 NYCRR Part 30) that takes effect on January 1, 2011  Reg%20194

Please especially examine the provisions of Section 30.3(a) - "Mandatory Initial Disclosure," Section 30.3(b) - "Disclosure Upon Request," Section 30.3(d) - "Disclosure of Reasonable Estimate of Compensation," Section 30.4 - "Retention of Disclosure," and Section 30.6 - "Obligations of an Authorized Insurer," for the main guts of Reg. 194.

The Department has also issued Circular Letter No. 18 (2010), dated November 5, 2010, in order to provide guidance on implementation of and compliance with Reg. 194 -

Limited Benefit Testimony

GCNYAHU received an invitation from the State of New York Insurance Department to testify on limited benefit plans.  The purpose of the hearings was to determine how these policies are marketed, assess what disclosures are made regarding covered services, evaluate any advantages these policies provide and determine whether additional oversight and regulation is required to protect consumers.  Kishan Perera, President Elect and Programs Chair of GCNYAHU, as well as Daniel Judge, Board Member of NYSAHU, provided testimony on September 30, 2009.  A copy of their testimony is attached via the link below.
